Trust & estate receivership

A neutral hand on assets the beneficiaries can’t agree on.

When a trust or estate holds real property and the parties are in conflict — a contested succession, a trustee accused of self-dealing, heirs at an impasse — the court can place the assets with a receiver. We hold, operate and account for them until the matter is resolved.

When trust and probate assets need a custodian

Trust and probate disputes frequently strand real property: a building sits unmanaged while the parties litigate, insurance lapses, taxes go unpaid and value erodes month by month. A court-appointed receiver stops that erosion without deciding who ultimately owns what.

We take custody of the real property and related accounts under the order, maintain and operate them, collect income, pay necessary expenses and keep a clean, auditable record for the court, the trustee, counsel and every beneficiary.

The role is strictly neutral. We do not adjudicate the trust dispute or advocate for an heir, a trustee or a creditor — we preserve the estate’s value so that whatever the court decides, there is still something worth deciding about.

What the engagement includes

01. Custody of trust real property

Immediate control of the real assets named in the order — access secured, insurance verified or reinstated, utilities and taxes brought current.

02. Income and expense administration

Rents and other income collected into a receivership account; necessary expenses paid on court-approved terms, with nothing commingled.

03. Accounting for the estate

A full accounting of assets, income, disbursements and condition — the record counsel and the court need when the dispute is finally heard.

04. Neutral party among beneficiaries

One point of contact for every heir, trustee and attorney, so operational decisions stop being another front in the litigation.

05. Sale or distribution support

When the court orders liquidation or distribution, broker coordination, marketing and clean transfer with documented proceeds.

What trustees, heirs and probate counsel ask

When does a court appoint a receiver in a trust or probate matter?

Typically when trust or estate property is at risk while the parties litigate — a contested succession, allegations of trustee misconduct, or heirs deadlocked over an asset that still needs managing.

Does the receiver replace the trustee or executor?

Not as to the trust itself. The receiver takes control only of the assets named in the order; the trustee or executor’s other duties continue unless the court limits them.

Who does the receiver answer to?

The court. We are neutral as between beneficiaries, trustees and creditors, and we report to the court and to all parties on the same terms.

Can you sell estate property during receivership?

Only with court authorization. When a sale is ordered, we coordinate brokers and marketing, and account for the proceeds to the court.

How are fees paid in a trust receivership?

Fees are court-approved and generally paid from the estate or the income of the assets under receivership, not by an individual beneficiary.
